It looks like the Supreme Court isn’t doing much to protect the public. The court has ruled that makers of medical devices are not liable for personal injuries if the device was approved by the Food and Drug Administration before being marketed. How safe does that approval make you feel? This ruling goes against stronger state regulations. With the number of approved drugs that are killing people, I no longer have much trust in the FDA. It’s not only drugs, which are regulated under separate laws than medical devices, more and more food items are being recalled. Where are the USDA inspectors? It looks like the federal government has really dropped the ball in a lot of areas.
With some of the rulings coming down from the Supreme Court I can’t help but wonder if some of them are in the pocket of big business and also pandering to the current administration. We are really stuck with the most recent right wing judges whose, rulings, in my opinion, seem to go against the constitution in some cases.
There is another case under consideration on a state case claiming that a drug maker committed fraud by misrepresenting or withholding information from the agency during the approval process. Of course the administration is supporting the manufacturer, siding with big business over the safety of the public.
